Kara L. Hilburger, Esq., CIPP/US counsels corporate clients on a myriad of labor and employment issues, including those touching upon technology and privacy matters. She works collaboratively with key organizational stake-holders to provide innovative and thoughtful advice and support in areas such as bring-your-own-device (BYOD) policies, social media and technology-use issues, contract preparation and review, workplace privacy concerns, and employee discipline matters. Kara has represented clients before administrative agencies, litigated state and federal employment matters and has extensive experience assisting her clients with reviewing and negotiating contract provisions.
Kara works closely with her clients as a strategic business partner to provide practical solutions to complex legal issues in the workplace She has worked with businesses in the private and public sector on a variety of labor and employment matters, including employment discrimination, workplace harassment, claims brought under Title VII, Americans with Disabilities Act, supervisory training, collective bargaining matters, and alternative dispute resolution proceedings. Kara has provided customized in-house training on a wide variety of topics including workplace harassment, state and federal regulatory compliance issues, and how to properly supervise and document the employment relationship.
Kara focuses her practice in the areas of compliance and counseling, advising and defending businesses whose websites and mobile apps have been accused of violating the Americans with Disabilities Act (ADA). She works closely with businesses to assess potential exposure and provide proactive guide in developing practical remedies and preventative compliance strategies that help eliminate issues before litigation arise.
Kara routinely advises clients with respect to data security and privacy, and compliance with federal and state laws across various industries. Her compliance practice includes helping companies implement consumer-facing policies, practices, and internal procedures effectively and efficiently while providing practical advice to continue business endeavors with maximum protection and risk management. She advises clients on e-commerce and privacy, the TCPA, social media law, COPPA, CAN-SPAM, and FTC regulations.
She works with clients that have received an ADA demand or lawsuit to quickly determine the best defense and/or resolution strategy as well as how to avoid future claims and lawsuits of the same type. She advises clients regarding steps they can take to remediate their websites and mobile apps, including assisting with third-party vendor selection and oversight and developing accessibility notices and policies for their customers and employees. Kara regularly writes and lectures on these subjects.
Kara has developed and conducted several training programs on topics such as social media use, sexual harassment, and conflict resolution in the workplace. She assists clients with a variety of corporate needs including contract review, licensing, women-owned business matters, and facilitating a culture of positive labor relations. Kara has led a number of social media initiatives and can help clients navigate through the legal implications, as well as the practical ones, in developing social media campaigns.
Kara is also a Certified Information Privacy Professional, United States (CIPP/US) as certified by the International Association of Privacy Professionals (IAPP).
